AMEM End User License Agreement
This agreement is between you (the "Licensee") and Adrenaline Games ("we") and governs your use of AMEM: the applications AMEM.exe and AMEM-cli.exe, the AMEM probe source files, the documentation and every update we deliver (together the "Software"). Installing or using the Software means you accept this agreement. If you do not accept it, do not install the Software.
1. LICENSES
All licenses are annual: they are valid for one year from the purchase date and can be renewed.
Indie: one named individual may install and activate the Software on up to 2 computers that they use (for example a desktop and a laptop). A company or team in which more than one person uses the Software needs Studio seats or a Studio Site license, whoever installs it.
Studio: each seat lets one company activate the Software on one computer. Buy as many seats as computers you use it on. Studio seats do not include build machines (CI).
Studio Site: one company may install and activate the Software on any number of computers and build machines that it owns or controls, for its own projects.
Enterprise: terms agreed in writing for that customer. Where a written Enterprise agreement differs from this one, the written agreement applies.
Captures (.amem files), reports, screenshots and any game, tool or other work you produce or improve with the Software are yours. No royalties, no attribution required.
2. TRIAL
The Software can start one free 14-day trial per computer, with the full feature set. The trial needs no payment details and no e-mail address and ends by itself. Entering a license key during or after the trial replaces it.
3. ACTIVATION AND WHEN THE LICENSE ENDS
Each purchase gets one license key. The key is activated online on each computer; a signed token then keeps the Software working offline for up to 30 days, and never beyond the end of the license period. A computer is identified by a one-way hash of its Windows machine identifier and the Windows user name. Reinstalling Windows or using another user account counts as a new computer. You can free a seat yourself on the seat page linked from the product page, or write to support.
When the license period ends and is not renewed, the Software stops working: it only shows the window for entering a license key. Your capture files stay on your computer and open again once a license is active.
Attempts to activate more computers than the license allows are refused. Keys found being shared publicly or used beyond their license are revoked without refund.
4. WHAT YOU MAY NOT DO
Share, sell, rent, sublicense or publish your license key, the installer or the application files. Reverse engineer, decompile or modify the Software to remove or bypass the licensing, or to build a competing product. Use an Indie license for more than one person, or any license across more than one company.
You may add the AMEM probe source files to your own projects and builds, change them for your own use and keep private backups of the installer.
5. DELIVERY, PAYMENT, REFUNDS
The license key and the installer link are e-mailed immediately after payment through PayPal to the address of your PayPal account. Prices are in USD, as shown at checkout. The Software is digital content: there are no refunds once the key has been issued. The 14-day trial exists so you can verify the Software on your computers before buying. By purchasing you request immediate delivery of digital content and acknowledge that you thereby lose any statutory right of withdrawal.
Support is part of the license: if the Software does not work on your computer, we work with you until it does. If we cannot make it work, we may, at our discretion, offer a refund or credit.
6. SUPPORT AND UPDATES
Support by e-mail (support@adrenalinegames.pl) or Discord; we aim to reply within two working days. Every update published during your license period is included. We may add, change or remove features between versions; the version you have installed is not changed without your action.
7. WHAT THE SOFTWARE DOES ON YOUR COMPUTER
The Software reads the memory, frame timing and CPU usage of programs you choose to measure. Frame timing and CPU sampling use Windows event tracing, which needs administrator rights: Windows asks you for permission once per capture, only a small helper process receives those rights, and it exits when the capture ends. The AMEM probe runs inside the programs you build it into.
The optional Optimize feature runs Claude Code, which you install and license from Anthropic yourself. When you press it, the work orders and the source files Claude Code reads are sent to Anthropic under their terms. Code changes are written only after you approve them, and every changed file gets a backup copy. You remain responsible for reviewing changes, for your backups and for your version control.
8. PRIVACY
The Software contacts our license server only to activate and check the license. It sends the license key, the one-way computer hash, the AMEM version and the computer name (shown on your seat page). It never sends your captures, source code, project names or file paths.
9. WARRANTY AND LIABILITY
The Software is provided "as is". We do not warrant that it is free of defects or that it fits a particular purpose. Measurements and findings are aids for your engineers, not guarantees about your product. To the extent permitted by law, our total liability for any claim related to the Software is limited to the amount you paid for it in the last 12 months, and we are not liable for indirect damages such as lost profits, lost data or project delays. Nothing in this agreement limits liability that cannot be limited by law.
10. TERMINATION
The license ends at the end of the license period unless renewed, or earlier if you breach section 4; in that case you must uninstall the Software. Sections 4, 9 and 11 survive termination.
11. GENERAL
Polish law applies, with the mandatory consumer protections of your country of residence unaffected. Changes to this agreement apply to purchases and renewals made after they are published; the version in force at your purchase or renewal governs your license. Contact: support@adrenalinegames.pl.
